Class “C” (Club) Special One Day Per Diem Permit – Alcoholic Beverage Article, Sections 33-1307 and 33-1309

Special and Temporary licenses shall be required in accordance with Section 33-1307 and 33- 1309 of the Maryland Alcoholic Beverages Article and shall be issued to any qualified, bona fide religious, fraternal, veterans, political, civic, or other nonprofit organization, when such organizations are having a function at which there will be a cash bar or admission charge or both, provided that the application for the license is filed with the Board at least thirty (30) days prior to the effective date of the license and the sponsoring group is responsible for enforcing compliance with current Maryland Alcoholic Beverage Laws and Rules, etc.

A Special One Day Per Diem Permit allows any qualified, bona fide religious, fraternal, veterans, political, civic, or other nonprofit organization to hold one-time events where alcoholic beverages are sold and consumed.

Applications must be submitted at least 30 days prior to your event. No exceptions.

The Type may be “Beer”, “Beer & Wine” or “Beer, Wine & Liquor”. The requirements and fees are generally much smaller for a Special One Day Per Diem permit than for other (permanent) types of licenses. Also, generally a public hearing is not required.
  • If the event is within the corporate limits of a municipality, the Mayor and City Council must sign the Special One Day Per Diem permit application approving the event. The application would need to be printed and supplied to the respective Mayor and City Council for the required signature.
  • If the event is NOT within the corporate limits of a municipality, the Mayor and City Council are not required to sign the respective application.
  • If it is the first time a particular non-profit organization is applying for a Special One Day Per Diem permit, that organization will be required to supply documentation showing their non-profit status.
  • The times which a Special One Day Per Diem permit may be granted cannot start prior to 9:00 a.m. Monday – Saturday or 12:30 p.m. on Sunday.
  • For any event where alcoholic beverages are sold and consumed, held by a bona fide non-profit organization, where participants are charged money in any way. (For profit organizations cannot obtain a One Day Per Diem permit)
  • If an event takes place where there is a ticket price to attend and that ticket price includes food as well as alcoholic beverages, a Special One Day Per Diem permit will be required.
  • For any event where alcoholic beverages are served and consumed and there is not any associated cost whatsoever, a Special One Day Per Diem Permit is not required.

•    May purchase beer & wine from a licensed MARYLAND WHOLESALER or a licensed MARYLAND RETAILER and liquor from a licensed MARYLAND RETAILER.
•    No other person or entity, including licensed retailers and/or distributors, and/or breweries, and/or manufacturers may bring ANY alcoholic beverages on the premises.  
•    Only the beer, wine and liquor that the organization has purchased from licensed MARYLAND WHOLESALERS or licensed MARYLAND RETAILERS is permitted on the premises—PERIOD.  This is written in the State law and the Maryland Comptroller’s rules and regulations (which carry the same weight as law).  No person can make exceptions to these laws.  Only the Maryland legislature can change the law.
•    The profits from the sale of alcoholic beverages under this permit are solely for the benefit of the applicant. Payment or sharing of any profits with a third party is a violation of the alcoholic beverage laws.
•    The applicant may not use a promoter to operate or conduct the event that is the subject of this application.
